1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between GlowDent (hereinafter referred to as "Seller") and consumers or entrepreneurs (hereinafter referred to as "Customer") regarding the products offered in the online shop.
1.2 Any differing terms and conditions of the customer shall not apply unless the seller expressly agrees to their validity in writing.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. A business is any natural or legal person who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Conclusion of the contract
2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
2.2 By completing the order process, the customer submits a binding offer to purchase the selected products.
2.3 The contract is concluded by express acceptance by the seller or at the latest upon dispatch of the goods.
3. Right of withdrawal
3.1 Consumers have a statutory right of withdrawal of fourteen days.
3.2 Details regarding the right of withdrawal can be found in the separate cancellation policy in the online shop.
4. Prices and Payment Terms
4.1 All prices stated in the online shop are final prices and include statutory VAT.
4.2 Any shipping costs will be shown separately during the ordering process.
4.3 Payment is made via the payment methods offered in the online shop (e.g. PayPal, credit card, Klarna, Apple Pay, Google Pay, Shopify Payments).
5. Shipping and Delivery Conditions
5.1 Delivery will be made to the delivery address specified by the customer within Germany and Austria.
5.2 The stated delivery time begins from the date of dispatch of the goods and is usually 5–10 working days , unless otherwise stated in the shop.
5.3 Delivery delays caused by shipping service providers, customs clearance or unforeseen events are outside the seller's control and do not give rise to any claim for damages.
5.4 All delivery times are non-binding unless they have been expressly confirmed in writing as binding.
5.5 Self-collection is not possible.
5.6 If a shipment is returned to the seller due to incorrect address information or non-acceptance, the customer shall bear the return shipping costs, provided that no cancellation has been exercised.
6. Retention of title
The delivered goods remain the property of the seller until full payment has been received.
7. Warranty
7.1 The statutory warranty rights apply.
7.2 For business customers, the warranty period is twelve months from delivery.
7.3 This does not affect claims for injury to life, body or health, or claims arising from intentional or grossly negligent conduct on the part of the seller.
8. Information on cosmetic products
8.1 GlowDent products are for cosmetic tooth whitening and do not replace dental treatment .
8.2 The effect may vary from person to person and does not guarantee success.
8.3 The products are not intended for children, pregnant women or persons with known dental diseases without prior consultation with a dentist.
9. Redeeming promotional vouchers
9.1 Promotional vouchers can only be redeemed within the specified period and only once per order.
9.2 Cash payment or combination of several vouchers is excluded.
10. Gift vouchers
10.1 Gift vouchers can be redeemed until the end of the third year after purchase.
10.2 Cash payment is excluded.
11. Liability
11.1 The seller is liable without limitation in cases of intent and gross negligence.
11.2 In cases of simple negligence, the seller is only liable for breaches of essential contractual obligations and only to the extent of foreseeable, typical damages.
11.3 Liability for indirect damages, consequential damages or lost profits is excluded.
11.4 Liability under the Product Liability Act remains unaffected.
12. Product information and errors
12.1 All product descriptions are provided to the best of our knowledge.
12.2 Deviations in color, appearance or effect due to technical or individual differences do not constitute a defect.
13. Claims for damages
The customer's claims for damages are excluded unless there is intent or gross negligence.
14. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies insofar as it does not restrict any mandatory consumer protection provisions of the country of residence.
15. Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution:

The seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
